What your notice must include
To be effective, your written notice must include all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to be infringed (or a representative list, if multiple works on a single site).
- Identification of the material claimed to be infringing, with enough detail for us to locate it — a direct URL on hellodebut.com is best.
- Your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.
Incomplete notices may not be processed. False or bad-faith notices may result in liability for damages under 17 U.S.C. section 512(f).
What we will do
On receipt of a complete notice, we will remove or disable access to the allegedly infringing material expeditiously and notify the affected user, providing them with a copy of the notice.
Counter-notice
If you believe material was removed by mistake or misidentification, you may submit a counter-notice to our designated agent containing:
- Your physical or electronic signature.
- Identification of the removed material and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, telephone number, and a statement consenting to the jurisdiction of the federal district court for the District of New Mexico (or, if you are outside the U.S., any federal district where Arcada may be found), and that you will accept service of process from the complainant.
If we receive a valid counter-notice and the original complainant does not file suit within 10 to 14 business days, we will restore the material.
Repeat infringers
We will terminate accounts of users who are repeat infringers in appropriate circumstances.
